In the aftermath of the DNs issues on privatskolen Westerdals have the ministry of education notified the requirement that privatskolen have to pay back a total of 56 million.

with 34.8 million of this is money the school received in state aid to operate the lines without the approval in several years. This was formally promoted as a requirement of the ministry 6. september and the deadline for appeal on the decision runs out Tuesday.

Westerdals is not going to complain, but certainly not the ball of death:

the School refuses to accept the claim, dropping the formal appellate body upheld – and are now going instead to the case against the ministry of education.

the King in council, that will say the government in the face of the Castle, is the administrative appeal body for decisions that are made in a ministry. Westerdals want instead to try the case before the court.

“After considering the decision carefully in consultation with the college’s legal advisors, the board of directors of Westerdals Oslo ACT decided that the college wants a judicial review of the lawfulness of the requirements and has decided that the matter should be referred directly to the ordinary courts of law.” states the message from the school Tuesday afternoon.

Our responsibility is to ensure that the Westerdals Oslo ACT do not incur costs to the college shall not have, and we look forward to having an independent body determine these questions. The ministry is notified about our decision, ” says the principal Tine to Widerøe in the message.

” We have had a close dialogue with the school in this matter, and it’s not totally unexpected that they will take the matter to court. It is a decision we take note, writes state secretary Bjørn Haugstad of the ministry of education to DN.

Ran the lines without approval

the Requirement of close to 35 million tied to the statstilskudd which was given to three of the Westerdals’ lines in the years before 2012.

the Lines were operated without formal approval, which is necessary to receive state aid. As DN has previously written got privatskolen still money of the state budget to operate the lines, because students were reported to the authorities that students at other, approved studies.

Students at the non-accredited film and television line, for example, were reported to the authorities that students at tekstforfatterlinjen in years.

In addition, the ministry notified that the Westerdals will be required for an additional 21 million, which is studiestøtte the students at these non-approved lines received from The loan fund, which they had not the right on. Westerdals tell DN that, however, they only have received a notice about this, and not a final decision, and therefore has not taken a position on the claim.

More cases in wait

the Alert from Westerdals on Tuesday comes just hours after the ministry of education reported that it opens to the supervision of privatskolen. The ministry warns a comprehensive review of the whole school – with particular attention on transactions between the school and the related companies in the same group.

Westerdals is owned by Anthon B Nilsen, owned by the brothers Nicolai and Peder Løvenskiold and Reidar and Gunnar Holsts legat. DN wrote last year autumn about how Westerdals' owners moved over 100 million dollars from the schools to the parent company, despite a ban on dividends. This happened in connection with the merger of the NITH, NISS and Westerdals in 2013.
